Cancellation Policy
Wintshield Safety Services LLC schedules safety audits, inspections, training, and consulting services in advance to ensure proper preparation and staffing. Clients must provide at least 48 hours’ written notice to cancel or reschedule any appointment. Cancellations made within 24 to 48 hours of a scheduled service will incur a 50% cancellation fee based on the total quoted service cost.
Cancellations made less than 24 hours in advance, including same-day cancellations or failure to provide facility access upon arrival, will result in a 100% cancellation fee. If unsafe weather, emergencies, or hazardous site conditions prevent the Company from performing the service, the Company reserves the right to reschedule without penalty. Cancellation fees must be paid in full before new services will be scheduled.
Client Service Agreement
This Client Service Agreement (“Agreement”) is between Wintshield Safety Services LLC (“Company”) and the Client identified in the corresponding service order. By scheduling or receiving services, the Client agrees to be bound by all terms outlined below.
Scope of Services
Wintshield Safety Services LLC provides workplace safety audits, OSHA compliance assessments, warehouse inspections, employee safety training, consulting, and program development (“Services”). The scope, cost, and timing of Services will be listed in the proposal or invoice provided to the Client.
Client Cooperation & Access
The Client agrees to provide full facility access, employee cooperation, and necessary records for the Company to perform Services. Failure to provide proper access may result in delays, incomplete work, or additional fees.
Payment Terms
Payment is due upon receipt of invoice unless otherwise stated. Completed work is non-refundable, and late payments may result in suspension of services.
Safety During Inspections
The Client must maintain a safe environment during inspections, including shutting down hazardous machinery, clearing walkways, and controlling dangerous conditions. The Company is not responsible for injuries caused by hazardous facility conditions.
Liability & Indemnification
Wintshield Safety Services LLC provides recommendations based on observed conditions at the time of service. Because compliance depends on Client implementation, the Company does not guarantee OSHA compliance. The Client agrees to indemnify the Company against claims arising from failure to follow recommendations, undisclosed hazards, misuse of training, or preexisting safety issues.
Photo & Documentation Authorization
The Client authorizes the Company to take photographs and documentation for reporting and internal use. Materials will not be publicly shared without permission unless required by law.
Confidentiality
The Company will maintain confidentiality of all proprietary information obtained during service. The Client agrees to keep Company materials confidential.
Independent Contractor
The Company operates as an independent contractor, not as an employee of the Client.
Arbitration Agreement
Any dispute arising under this Agreement shall be resolved through binding arbitration in the State of New Jersey. By agreeing to these terms, the Client waives the right to file a lawsuit, waives the right to a judge or jury trial, and waives participation in class actions.
Governing Law
This Agreement shall be governed by New Jersey law.
Entire Agreement
This Agreement and accompanying service documents constitute the entire agreement between the parties.
